Terms and Conditions of AUTOLUX SELECT CARS S.L.

1. Introduction and Acceptance of Terms

Welcome to AUTOLUX SELECT CARS S.L. ("Select Cars", "we", "us", "our"). These Terms and Conditions ("Terms") govern the use of our transport services, our website (www.taxi-barcelona-airport.com), mobile applications (if applicable), and any other digital services or platforms we offer (collectively, the "Services").

By registering, browsing our website, or using any of our Services, you ("User", "you", "your") confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference and complies with European Union data processing regulations (Regulation EU 2016/679).

If you do not agree with any of these Terms, you should not use our Services.

Some Services may be subject to specific additional terms and conditions, which will be presented to you and will be considered part of these Terms.

2. Legal Capacity

You declare and warrant that you are at least 16 years of age to contract our Services. If you are under 16, you cannot, under any circumstances or for any reason, contract our Services directly. In such cases, your legal guardians may contract the Services on your behalf, accepting and complying with these Terms.

3. Account Registration

To access and use certain Services, it is essential to register and create an account ("Account"). You agree to:

1. Provide truthful, accurate, current, and complete information during the registration process.
2. Maintain and promptly update your Account information to keep it truthful, accurate, current, and complete.
3. Not use another person's Account without authorization.
4. Be solely responsible for all activity that occurs on your Account and for maintaining the confidentiality and security of your password. Notify us immediately of any unauthorized use of your Account.

4. Transport Services

a. Service Request:

Transport services must be requested at least one (1) hour in advance via email, our website, application (if applicable), or phone. Confirmation of the service will depend on our availability and will be communicated by our customer service.

b. Service Details:

The service conditions will be specified in advance and must be strictly followed. These include, but are not limited to: client details, start date and time, pickup location, intermediate stops (if any), end date and time, destination location, number of passengers, vehicle/service type and category, need for child/infant seats, luggage details, and payment method.

c. Punctuality and Waiting Times:

Our drivers will arrive at the meeting point in advance. Failure by the User to adhere to the scheduled start time may result in additional waiting time costs. After one (1) hour from the agreed start time without the User's appearance, Select Cars reserves the right to cancel the service without a refund, except as specified for airport pickups.

d. Pickups at Airports, Ports, and Stations:

The User is responsible for properly calculating the pickup time. For airport pickups, one (1) hour of waiting time is included at no additional cost in case of flight delays or other justified causes beyond the User's control.

e. Service Modifications:

Once the service has started, the User may not instruct the driver to make route changes, new stops, or modifications to the agreed-upon conditions without first contacting our customer service. Customer service will evaluate the feasibility of the request, which may involve a price recalculation.

f. Minors and Luggage:

The User must inform in advance if minors are traveling to provide, if necessary, the appropriate type of child seat. Similarly, they must inform about the luggage volume. Exceeding the vehicle's luggage limit or transporting dangerous or illegal materials is not permitted.

5. Prices and Payments

a. Rates:

The prices of the Services will be those indicated at the time of contracting or confirmation.

b. Online Payments:

For online payments, we use the secure platform REDSYS (or another similar platform that may be indicated) in redirection mode. Select Cars does not store your credit or debit card data. When making the payment, you will be redirected to the secure payment gateway (using SSL/HTTPS protocol). The payment platform may use authentication systems such as 3D Secure. Once the payment is completed, the platform will communicate the result of the operation to us, and you will be redirected to our portal.

6. Cancellations and Refunds

a. Cancellation by the User:

You may cancel any service at no cost with a minimum of twenty-four (24) hours' notice before the scheduled start time of the service.

b. Refunds:

Refunds will be processed at the time of cancellation or as soon as possible, using the same payment method used for the booking.

c. Cancellations with Less Than 24 Hours Notice:

For cancellations made with less than 24 hours' notice, a charge of up to 100% of the service amount may be applied. This policy is due to the fact that services are scheduled and drivers' schedules are assigned in advance, and late cancellations can cause financial loss. Contact our customer service to evaluate your specific case.

d. Cancellation by Select Cars:

We reserve the right to cancel a service due to force majeure, unforeseen unavailability, or non-compliance with these Terms by the User. In the event of a cancellation on our part (not attributable to the User), a full refund or a viable alternative will be offered.

7. Privacy and Data Protection

Our Privacy Policy, which complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, details how we collect, use, store, and protect your personal data. We do not use invasive session cookies (it could be specified if technical or anonymous analytical cookies are used). Your personal data will not be shared with third parties without your consent, except as required by law.

8. Intellectual Property

All content on our Services, including texts, graphics, logos, icons, images, software, and source code, is the property of Select Cars or its licensors and is protected by intellectual and industrial property laws. Its reproduction, distribution, public communication, or transformation without the express authorization of Autolux is prohibited.

9. Limitation of Liability

To the maximum extent permitted by applicable law, TSelect Cars shall not be liable for indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (I) your access to or use of or inability to access or use the Services; (II) any conduct or content of any third party on the Services; (III) any content obtained from the Services; and (IV) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the use of the Services shall not exceed the total amount paid by you to Select Cars for the specific service that gave rise to the claim.

10. Dispute Resolution and Applicable Law

a. Arbitration:

Any dispute, controversy, or claim arising from or related to these Terms, their breach, termination, enforcement, interpretation, or validity, or the use of the Services, shall be resolved by binding individual arbitration administered by the Barcelona Arbitration Court in accordance with its current arbitration rules.

b. Waiver of Class Actions:

You waive your right to participate as a plaintiff or class member in any class action or representative proceeding against Select Cars.

c. Applicable Law:

These Terms shall be governed and construed in accordance with the laws of Spain and, where applicable, the regulations of the European Union.

11. Modifications to the Terms

Select Cars reserves the right to modify these Terms at any time. If we make changes, we will notify you by posting the updated Terms on our website and updating the "Last Updated Date". Your continued use of the Services after the posting of the changes will constitute your acceptance of such changes. We recommend you review the Terms periodically.
